Terms of Service
These terms cover jahfeelautomation.com and the pilot builds and related services provided by JahFeel Automation Services. By using the site or hiring me, you agree to them. If you and I sign a scope page or another written agreement for a pilot, that document controls wherever it says something different from these terms.
The short version: one workflow, fixed scope, fixed price, built inside accounts you own, and yours to keep. I am responsible for building it to the scope you approved. You are responsible for how it is used in your business, and for approving anything it sends or changes on your behalf.
1. Who you are dealing with
JahFeel Automation Services is owned and run by Bryan Alva. "I" and "me" in these terms means JahFeel Automation Services. Eduba supplies the method I use and certifies my work. Eduba is not a party to your agreement and has no obligations to you under it.
2. What I provide
A pilot build: one workflow, defined on a one page scope with a fixed price, built in three phases (Questions, Processes, Implementation and Testing) inside tools and accounts that you own. The scope page says what is included, what done looks like, and what it costs. Anything not on the scope page is not included. I also publish free guides and demo tools on the site, covered in section 12.
3. Eligibility
The site and my services are for business use by people 18 or older. If you hire me on behalf of a business, you confirm you have the authority to do so.
4. How a pilot works
- Questions. A 30 minute call, then I write down your real rules and send you a one page scope with a fixed price. You approve it in writing, or we stop there and you owe nothing.
- Processes. I build the workflow to the scope, in your accounts. Where the scope calls for a human review step, the workflow waits for one.
- Implementation and Testing. The workflow runs on your real jobs alongside the old way until the output matches the process you approved. If the first version needs more work to match the scope, that is on me, not on your invoice.
- Handoff. When it holds, I hand it off, remove my access unless you ask me to keep it for support, and it keeps running whether or not you ever call me again.
5. Your responsibilities
- Give me accurate information and the access the scope page lists, when it is needed.
- Answer the questions in the Questions phase and review the output during testing. The timeline depends on it.
- Keep the accounts the workflow runs in active and in good standing, and pay any fees those tools charge you.
- Use the workflow lawfully. Any data you give it or let it touch must be data you have the right to use.
- You are the sender of every message the workflow sends to your customers, and you are responsible for having their permission, for honoring opt outs, and for complying with the TCPA, CAN-SPAM and any rules that apply to your industry.
- Keep a person on every approval step the scope page marks as one. Do not remove a review step and then rely on the workflow as if it were still there.
- Tell me right away if something looks wrong.
6. Fees and payment
The price is the fixed price on the scope page, and the scope page states when it is due. There is no bill for the call or the scope itself. Ongoing upkeep, if you choose it later, is priced in writing the same way, runs month to month, and you can stop it at any time. If you stop upkeep, the workflow keeps running in your accounts. Upkeep is help keeping it current, not a license to keep using it. Work beyond the scope page is a new line on paper before I do it, never a surprise on the invoice.
7. Ownership and handoff
At handoff, the workflow, its configuration, prompts, templates, documents and data are yours, in your accounts. I keep the right to reuse my general know-how, methods, templates and components that are not specific to your business, and to build similar workflows for other clients. I will not reuse your business information, your data or anything that identifies you without your written permission.
8. Third party tools and AI
Your workflow runs on tools and AI models from other companies, on accounts in your name, under their terms and at their prices. I do not control those companies. They can change features, pricing or availability, and the workflow may need adjusting when they do. AI output can be wrong. The scope page says where the workflow includes a review step, and you are responsible for checking anything the workflow produces before it goes to a customer, a regulator, a court, or a financial system, whether or not a review step is built in.
9. Confidentiality
I keep what I learn about your business confidential and use it only to do the work, except for what you agree in writing that I may share, such as a case study you approve. This does not cover information that is already public or that I am required by law to disclose.
10. Acceptable use
You may not use the site, the demo tools, or anything I build for you to break the law, send spam or unwanted messages, deceive people, infringe someone's rights, or interfere with the site or with other people's systems. I can decline or stop work that would put me or you on the wrong side of these rules.
11. Ending a pilot early
Either of us can end a pilot in writing before handoff. If you end it, you pay for the phases completed to date as the scope page describes. If I end it for a reason other than your breach of these terms, you pay nothing for work that was not completed, and I refund anything you paid for it. Either way, anything already built in your accounts stays with you.
12. Guides and demo tools
The guides on this site are general information, not legal, financial, tax or professional advice. Some were written with AI assistance and some describe products or prices that have since changed. The demo tools are working examples loaded with sample data. Use them to see what a workflow can look like, not to run your business. I may change or remove guides and demos at any time.
13. Warranties
I will do the work with reasonable skill and care, to the scope you approved. Beyond that, the site, the demo tools and any workflow are provided as is. I do not promise a particular business result, that a third party tool will keep working the way it does today, or that AI output will always be correct.
14. Limitation of liability
To the fullest extent the law allows, my total liability to you for anything arising out of a pilot is limited to the fees you paid me for that pilot. I am not liable for lost profits, lost revenue, lost data, or indirect or consequential damages, even if I was told they were possible. Nothing in these terms limits liability that cannot be limited under Arizona law.
15. Indemnification
You agree to cover me for claims, losses and costs that come from your use of the workflow, the data you put into it, the messages it sends to your customers on your behalf, or your breach of these terms.
16. Governing law and disputes
These terms are governed by the laws of the State of Arizona. If we have a disagreement, we talk first. If that does not resolve it, the courts of Maricopa County, Arizona have exclusive jurisdiction, and you agree to that.
17. Changes to these terms
If I change these terms, the date at the top changes with it. A pilot already in progress stays on the terms in place when its scope page was approved.
